Jason Madden LL.B

Jason Madden is co-managing partner of Pape Salter Teillet LLP. Jason Madden is a graduate of Osgoode Hall Law School and is called to the bar in Ontario, Yukon, the Northwest Territories, Alberta, and Manitoba. He specializes in Indigenous rights law, with an emphasis on litigation, consultation and accommodation related matters, and the negotiation and implementation of modern day treaties. He is also recognized as being at the forefront of the development of Métis rights law in Canada.

Jason’s litigation practice focuses on a range of areas impacting Indigenous communities, including constitutional law, administrative law, environmental and regulatory law, Indigenous rights, treaty and self-government issues and dispute resolution. He has represented clients before the Supreme Court of Canada, the Federal Court of Appeal as well as all levels of court from Ontario westward. He has also appeared before many regulatory boards and tribunals, including, Joint Review Panels of the National Energy Board and the Canadian Environmental Assessment Agency, the Clean Environment Commission (Manitoba), the Ontario Energy Board and the Yukon Water Board to name a few.

Jason has extensive experience advising clients on consultation and accommodation related issues, including, the negotiation of impact, benefit, resource sharing, partnership and environmental protection agreements for Aboriginal groups. He also regularly advises and acts for First Nation and Métis communities in the negotiation and implementation of agreements related to the recognition of Aboriginal rights, self-government and modern day treaties. This work includes the development of internal laws, policies and processes, the negotiation of financial transfer and tax agreements as well as inter-nation, intergovernmental and trans-boundary arrangements.

Jason is a regular speaker at conferences and law schools on Indigenous legal issues generally and Métis legal issues specifically. In 2014, he was recognized by Canadian Lawyer Magazine as one of the 25 Most Influential Lawyers in Canada. He is also the recipient of the 2015 Osgoode Hall Law School Dianne Martin Award for the Advancement of Social Justice through Law and the Queen Elizabeth II Diamond Jubilee Medal. He is ranked by both Lexpert (“consistently recommended”) and Chambers & Partners as a leading practitioner in Aboriginal law.

Jason is Métis and a descendant of the ‘Halfbreeds of Rainy River and Rainy Lake’ who collectively adhered to Treaty No. 3 in 1875.
